Article 1: Applicability
The general terms and conditions apply to every offer from On Style BV (ontuning.be) and to every distance contract concluded between On Style BV and the consumer.
One or more articles of the general terms and conditions may only be deviated from by means of a prior written agreement between On Style BV and the consumer. The other provisions of these general terms and conditions will then remain in force.
When placing an order at ontuning.be or signing an agreement with On Style BV and by accepting an offer from On Style BV, the consumer declares to have read and understood the general terms and conditions and to fully and irrevocably agree with the content and its applicability to all legal relationships with On Style BV.
The general terms and conditions used by the consumer do not apply unless expressly agreed to by On Style BV.
On Style BV reserves the right to change and/or supplement the general terms and conditions at any time.
On Style BV is authorized to rely on third parties in the execution of an agreement with the consumer.
Article 2: Definitions
Reflection period: the period within which the consumer can exercise his right of withdrawal;
Consumer: any natural person who acts for purposes that fall outside his trade, business, craft or profession;
Day: calendar day;
Right of withdrawal: the consumer's option to cancel the distance contract within the cooling-off period;

Article 3: The offer
The offer contains a complete and accurate description of the products offered. The description, which contains an explanation of the characteristics of the good, is sufficiently detailed to enable a proper assessment of the offer by the consumer. If On Style BV uses images, these are a true representation of the products offered. Obvious mistakes or errors in the offer do not bind On Style BV.
If the offer has a limited period of validity and is made subject to conditions, this will be expressly stated in the offer. An agreement is concluded when an order confirmation has been handed over to the consumer, and/or if the offer has been made via the ontuning.be website, has been sent by e-mail to the e-mail address provided by the consumer.
The consumer and On Style BV expressly agree that a valid agreement can be concluded by using electronic means of communication. The absence of a normal signature does not affect the binding force of the offer and its acceptance. To the extent permitted by law, On Style BV's electronic files serve as presumption of evidence.
All offers are valid while supplies last.
Article 4: The agreement
The agreement is concluded when the consumer accepts the offer and meets the conditions set.
If the offer is accepted electronically by the consumer, On Style BV will immediately confirm receipt of acceptance of the offer electronically. As long as receipt of this acceptance is not confirmed by On Style BV, the consumer can terminate the agreement.
On Style BV can inform itself within legal frameworks
whether the consumer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, based on this investigation, On Style BV has good reasons not to enter into the agreement, it is entitled to refuse an order or request with reasons or to attach special conditions to the execution.
Article 5: Price
The prices stated on quotations and agreements are expressed in EURO. All prices on ontuning.be include VAT, excluding shipping costs.
Shipping costs are calculated based on weight and volume. Shipping costs vary depending on the country. The delivery costs are clearly communicated to the consumer. All other possible costs are also clearly communicated to the consumer.
The prices of the products offered will not be quoted during the period of validity stated in the offer, except for price changes as a result of changes in VAT rates. This can be deviated from if the prices of the products are subject to fluctuations in the financial market over which On Style BV has no influence. The obligation to fluctuate and that any prices stated are target prices are also stated in the offer.
Article 6: Delivery and delivery time
Orders are delivered as quickly as possible. On Style BV will always exercise the utmost care when receiving and executing orders for products. On Style BV strives to ship orders within 5 days.
Taking into account Article 4 of these general terms and conditions, On Style BV will execute accepted orders expeditiously, but no later than within 30 days. This can be deviated from if a different delivery period has been agreed between the consumer and On Style BV.
Products can be collected on site or shipped via courier services by On Style BV to the delivery address as specified by the consumer. From the moment that products to be delivered have been delivered to the specified delivery address, the risk regarding these products passes to the consumer. The risk of loss, destruction or damage to products (regardless of the cause) rests with On Style BV until the moment of delivery to the consumer.
Different provisions may apply to deliveries abroad. When deliveries are made in parts, On Style BV has the right to regard each delivery as a separate transaction.
If delivery is delayed or if an order can only be partially fulfilled, the consumer will be notified no later than 30 days after the order has been placed. In that case, the consumer has the right to terminate the agreement without costs, if On Style BV is informed of this within 24 hours. After terminating the agreement, On Style BV will immediately refund the amount paid by the consumer.
If the consumer orders a product that is temporarily out of stock, it will be indicated when the product is available again. On Style BV strives to report any delays to the consumer by telephone or e-mail within two working days.
Article 7: Retention of title
Ownership of a product is only transferred to the consumer after he or she has fully paid the payment due for this product (including delivery costs).
The consumer may not tax, sell, resell, dispose of or otherwise store the products before ownership has been transferred.
Article 8: Payment
Orders via the ontuning.be webshop can be paid in the following ways:

- Credit card (MasterCard, Visa..)

- Applepay
- Googlepay
For orders placed at the registered and visiting address of On Style BV (ontuning.be), payment can be made in the following ways:
- Bancontact (Payconiq)
- In cash
If a payment term has been agreed by On Style BV, the consumer will only be in default if this term has expired.
If the consumer chooses a payment method by credit card, the terms and conditions of the relevant card issuer apply. On Style BV is not a party to the relationship between the consumer and the card issuer.
When the order is registered, a confirmation will be sent to the specified email address. The order will only be processed after receipt and collection of the amount to be paid.
In the event of non-payment or late payment by the consumer, the consumer owes interest on the outstanding amount at the statutory interest rate, calculated from the day on which payment should have been made until the day of full payment.
All legal costs of whatever nature incurred by On Style BV as a result of the consumer's failure to fulfill his obligations will also be borne by the consumer.
If the consumer does not pay on time, On Style BV is entitled to terminate the agreement with immediate effect or to suspend delivery until the consumer has fully fulfilled his payment obligations (including interest and costs owed).
Article 9: Warranty and liability
On Style BV guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and the legal provisions and/or government regulations in force on the date of the conclusion of the agreement.
If the delivered products do not comply with the agreement, the consumer must notify On Style BV within a period of seven days.
If On Style BV is obliged to compensate any damage to the consumer who is not a consumer buyer, that compensation will never exceed an amount equal to the invoice value with regard to the product or service that caused the damage.
There can be no warranty in the following cases:
- if the wear and tear can be considered normal, if changes have been made to the product, including repairs that have not been carried out with the permission of On Style BV
- if the original invoice has been changed or made illegible;
- if defects are the result of failure to correspond with the intended use or improper use;
- if damage has been caused by intent, gross negligence or negligent maintenance.
If research costs are incurred to identify a defect in the product or part of the product, which is excluded from the warranty, and these costs remain excluded from the warranty, these costs will always be borne by the consumer. On Style BV strives to report this in advance. Failure to notify this does not release the consumer from the obligation to pay these costs.
If costs are involved in repairing a defect and this repair appears to be excluded from the warranty on the basis of this article, the consumer will be informed of this. If the consumer does not expressly agree in writing with the cost estimate, he or she can receive her property back upon payment of the research costs. If the consumer has not paid these research costs three months after submitting the cost estimate, ownership of the product will lapse to On Style BV.
Article 10: Right of withdrawal and associated costs
When you purchase a product on ontuning.be , you, as a consumer, can renounce your purchase for 14 days from the day of delivery, taking into account article 10 of these general terms and conditions. You have this period of time to inform us of the decision to return the product.
We (On Style BV) will refund the full purchase price within 14 calendar days after we have received your order back or you have indicated that you wish to cancel the agreement.
If the goods are manufactured according to the customer's specifications, they are personal in nature and cannot be taken back. As a result, canceling an order is not possible.
On Style BV is not liable for any damage, theft or loss that occurs to the packaging or product upon return. If the product has not been received in accordance with the conditions of the right of withdrawal, the purchase amount will not be refunded. Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned. The product remains the property of the consumer, who is obliged to collect its property within 14 calendar days. The product can also be delivered at the consumer's request.
During the cooling-off period, the consumer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to determine the nature, characteristics and operation of the product. For example, he will not paint the product nor incorporate it into another good or mount it on a vehicle. The basic principle here is that the consumer may only handle and inspect the product as he would in a store.
The consumer bears the direct costs of returning the product. On Style BV uses the same payment method for reimbursement
the consumer has used, unless the consumer agrees to another method. The refund is free of charge for the consumer. If the consumer has opted for a more expensive method of delivery than the cheapest standard delivery, On Style BV does not have to reimburse the additional costs for the more expensive method.
Article 11: Complaints procedure
The consumer is obliged to carefully inspect the products immediately upon receipt. Complaints from the consumer relating to defects in the product or the delivery that are externally visible must be submitted by the Buyer within seven days of delivery (or within seven days of the invoice date if the products could not be delivered to the consumer). , will be notified in writing to On Style BV.
The consumer is not entitled to return products for which there are no substantiated complaints. If this happens without valid reasons, all costs associated with return will be borne by the consumer. In that case, On Style BV is free to store the products among third parties at the expense and risk of the consumer and to return them to the consumer at the request and expense of the consumer.
Article 12: Force majeure
In the event of force majeure, On Style BV is not obliged to fulfill its obligations towards the other party. On Style BV is entitled to suspend its obligations for the duration of the force majeure.
Force majeure means any circumstance beyond its control that prevents the fulfillment of its obligations towards the other party in whole or in part. These circumstances include strikes, fire, business disruptions, energy disruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or the unavailability of the webshop at any time, non-delivery or late delivery from suppliers or other third parties engaged and the lack of any permit to be obtained from the government.
Article 13: Disputes
Only Belgian law applies to agreements between On Style BV and the consumer to which these general terms and conditions apply. Agreements between On Style BV and the consumer are exclusively governed and interpreted in accordance with Belgian law.
In the event of any disputes regarding the validity, interpretation or implementation of such agreements, the consumer must first contact On Style BV for an amicable settlement.
In the absence of an amicable settlement, all disputes or disagreements that may arise from the agreements concluded between On Style BV and the consumer will be submitted to the competent courts.
Article 14: Personal data
On Style BV will only process consumer data in accordance with its Privacy Statement. The applicable laws and regulations are taken into account.
Article 15: Intellectual property
The consumer expressly acknowledges that all intellectual property rights of displayed information, communication or other expressions relating to the products and/or the webshop belong to On Style BV, its suppliers or other rights holders.
Intellectual property rights include patent, copyright, trademark, drawing and model rights and/or other (intellectual property) rights, including patentable or non-patentable technical and/or commercial know-how, methods and concepts.
The consumer is prohibited from using and/or making changes to the intellectual property rights as described in this article, such as copy, reproduction, redistribution and sublicense, without the express prior written permission of On Style BV, its suppliers or other rights holders. , unless it concerns purely private use of the product itself.
Article 16: Reviews
Parts of this website offer the opportunity for users to post and exchange opinions and information in certain areas of the website. Ontuning.be does not filter, edit, publish or review comments prior to their presence on the website. Comments do not reflect the views or opinions of Ontuning.be, its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable law, Ontuning.be shall not be liable for the Comments or any liability, damages or expenses caused and/or suffered as a result of any use of, and/or posting of, and/or appearance of the comments on this website.

On Style BV strives to answer emails within 24 hours. If complaints are reported to On Style BV, the consumer will in any case be informed within 14 working days of the period in which he will receive a proposal to resolve the dispute from On Style BV.
If any provision of these Terms and Conditions shall be unlawful, void, or for any other reason unenforceable, then such provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. These General Terms and Conditions constitute the complete agreement between the consumer and On Style BV with regard to the subject matter contained therein.
In the event of nullity, invalidity or unenforceability of a provision, On Style BV and the consumer will make every effort to replace the provision with a valid and enforceable provision that comes closest to the intentions of the parties.
These general terms and conditions cannot be tacitly deviated from. Merely tolerating behavior by the consumer contrary to the agreed terms and conditions does not imply a waiver by On Style BV of the content of the general terms and conditions.
