- General Terms and Conditions
Article 1: Applicability
These general terms and conditions apply to every offer made by On Style BV (ontuning.be) and to every distance contract concluded between On Style BV and the consumer.
One or more articles of the general terms and conditions may be deviated from only by prior written agreement between On Style BV and the consumer. The other provisions of these general terms and conditions will then remain in force.
By placing an order with ontuning.be or signing an agreement with On Style BV and by accepting an offer from On Style BV, the consumer declares to have read and understood the general terms and conditions and to fully and irrevocably agree to their content and applicability to all legal relationships with On Style BV.
The general terms and conditions used by the consumer are not applicable, unless explicitly agreed upon by On Style BV.
On Style BV reserves the right to change and/or supplement the general terms and conditions at any time.
On Style BV is authorized to engage third parties in the execution of an agreement with the consumer.
Article 2: Definitions
Reflection period: the period within which the consumer can exercise his right of withdrawal;
Consumer: any natural person who acts for purposes outside his trade, business, craft or profession;
Day: calendar day;
Right of withdrawal: the possibility for the consumer to waive the distance contract within the reflection period;

Article 3: The Offer
The offer contains a complete and accurate description of the products offered. The description, which explains the characteristics of the goods, is sufficiently detailed to allow a proper assessment of the offer by the consumer. If On Style BV uses images, these are a true representation of the products offered. Obvious mistakes or errors in the offer do not bind On Style BV.
If the offer has a limited validity period under certain conditions, this will be explicitly stated in the offer. An agreement is concluded at the moment an order confirmation has been handed over to the consumer, and/or if the offer was made via the website ontuning.be, it has been sent by e-mail to the e-mail address provided by the consumer.
The consumer and On Style BV explicitly agree that a valid agreement can be concluded by using electronic means of communication. The absence of an ordinary signature does not detract from the binding force of the offer and its acceptance. To the extent permitted by law, On Style BV's electronic files serve as presumptive evidence.
All offers are valid while stocks last.
Article 4: The Agreement
The agreement is concluded at the moment the consumer accepts the offer and fulfills the conditions set therein.
If the offer is accepted electronically by the consumer, On Style BV will immediately confirm receipt of the acceptance of the offer by electronic means. As long as the receipt of this acceptance has not been confirmed by On Style BV, the consumer can dissolve the agreement.
On Style BV can, within legal frameworks, inform itself
whether the consumer can meet his payment obligations, as well as of all facts and factors that are important for a responsible conclusion of the distance contract. If On Style BV, based on this investigation, has good grounds not to enter into the agreement, it is entitled to refuse an order or request with reasons or to attach special conditions to its execution.
Article 5: Price
The prices stated on quotations and agreements are expressed in EURO. All prices on ontuning.be are inclusive of VAT, excluding shipping costs.
Shipping costs are calculated based on weight and volume. Shipping costs vary depending on the country. Delivery costs will be clearly communicated to the consumer. Any other possible costs will also be clearly communicated to the consumer.
The prices of the products offered will not be increased during the validity period stated in the offer, provided that price changes are a result of changes in VAT rates. This may be deviated from if the prices of the products are subject to fluctuations in the financial market over which On Style BV has no influence. The binding nature of fluctuations and any stated prices being target prices will also be mentioned in the offer.
Article 6: Delivery and Delivery Time
Orders will be delivered as quickly as possible. On Style BV will always exercise the greatest possible care when receiving and executing product orders. On Style BV strives to ship orders within 5 days.
Taking into account article 4 of these general terms and conditions, On Style BV will execute accepted orders promptly, but no later than within 30 days. This may be deviated from if a different delivery period has been agreed upon between the consumer and On Style BV.
Products can be collected on site or shipped via courier services by On Style BV to the delivery address specified by the consumer. From the moment the products to be delivered have been delivered to the specified delivery address, the risk concerning these products transfers to the consumer. The risk of loss, damage or deterioration of products (regardless of the cause) rests with On Style BV until the moment of delivery to the consumer.
Different provisions may apply for international deliveries. In the case of deliveries made in parts, On Style BV has the right to consider each delivery as a separate transaction.
If delivery is delayed or if an order can only be partially executed, the consumer will receive notification of this no later than 30 days after the order was placed. In that case, the consumer has the right to dissolve the agreement without costs, provided On Style BV is notified within 24 hours. After dissolving the agreement, On Style BV will immediately refund the amount paid by the consumer.
If the consumer orders a product that is temporarily out of stock, it will be indicated when the product will be available again. On Style BV strives to notify the consumer of any delays by telephone or e-mail within two working days.
Article 7: Retention of Title
Ownership of a product will only transfer to the consumer after the consumer has fully paid the amount due for this product (including delivery costs).
The consumer may not encumber, sell, resell, alienate, or otherwise keep the products before ownership thereof has transferred.
Article 8: Payment
For orders placed via the webshop ontuning.be, payment can be made in the following ways:

- Paypal
- Maestro
- Credit card (MasterCard, Visa...)
- Amex
- Apple Pay
- Google Pay
For orders placed at the establishment and visiting address of On Style BV (ontuning.be), payment can be made in the following ways:
- Bancontact (Payconiq)
- Cash
If On Style BV has agreed on a payment term, the consumer is only in default after the expiration of this term.
If the consumer chooses a credit card payment method, the terms and conditions of the relevant card issuer apply. On Style BV is not a party in the relationship between the consumer and the card issuer.
When the order is registered, a confirmation will be sent to the specified e-mail address. The order will only be processed after receipt and collection of the amount due.
In case of non-payment or late payment by the consumer, the consumer owes interest on the outstanding amount at the statutory interest rate, calculated from the day on which payment should have taken place at the latest until the day of full settlement.
All judicial costs of any nature whatsoever, incurred by On Style BV as a result of the consumer's non-fulfillment of his obligations, shall also be borne by the consumer.
If the consumer does not pay on time, On Style BV is authorized to dissolve the agreement with immediate effect or to suspend delivery until the consumer has fully met the payment obligations (including accrued interest and costs).
Article 9: Warranty and Liability
On Style BV guarantees that the products comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations existing on the date of the conclusion of the agreement.
If the delivered products do not comply with the agreement, the consumer must notify On Style BV within seven days.
If On Style BV is obliged to compensate any damage to the consumer who is not a consumer buyer, that compensation will never exceed an amount equal to the invoice value relating to the product or service that caused the damage.
There can be no warranty in the following cases:
- if wear and tear can be considered normal, if changes have been made to the product, including repairs that have not been carried out with the consent of On Style BV
- if the original invoice has been altered or made illegible;
- if defects are the result of improper use or use inconsistent with the intended purpose;
- if damage has occurred due to intent, gross negligence or negligent maintenance.
If, for identifying a defect in the product or part of the product that is excluded from warranty, investigation costs are incurred and these costs prove to be excluded from warranty, these costs shall always be borne by the consumer. On Style BV strives to report this in advance. Failure to report this does not release the consumer from the obligation to pay these costs.
If there are costs associated with repairing a defect and this repair proves to be excluded from warranty based on this article, the consumer will be informed thereof. If the consumer does not explicitly agree in writing to the cost estimate, they can receive their property back upon payment of the investigation costs. If the consumer has not paid these investigation costs three months after the cost estimate was offered, ownership of the product will revert to On Style BV.
Article 10: Right of Withdrawal and Associated Costs
When you purchase a product on ontuning.be, as a consumer, you can withdraw from your purchase within 14 days from the day of delivery, taking into account article 10 of these general terms and conditions. You have this period to notify us of your decision to return the product.
Within 14 calendar days after we have received your order back or you have indicated that you wish to withdraw from the agreement, we (On Style BV) will refund the full purchase price to you.
In cases where goods are manufactured according to customer specifications, they have a personal character and cannot be returned. Consequently, cancellation of an order is not possible.
On Style BV is not liable for any damage, theft, or loss to the packaging or product that occurs during return shipment. If the product is not received in accordance with the conditions of the right of withdrawal, the purchase amount will not be refunded. Only articles that are in their original packaging, together with all accessories, user manuals, and the invoice or proof of purchase, can be returned. The product remains the property of the consumer, who is obliged to collect their property within 14 calendar days. At the consumer's request, the product can also be delivered.
During the reflection period, the consumer will handle the product and its packaging with care. He will only unpack or use the product to the extent necessary to ascertain the nature, characteristics, and functioning of the product. For example, he will not paint the product, incorporate it into another good, or mount it on a vehicle. The basic principle here is that the consumer may only handle and inspect the product as he would be allowed to do in a shop.
The consumer bears the direct costs of returning the product. On Style BV uses the same payment method for reimbursement that
the consumer used, unless the consumer agrees to another method. The reimbursement is free of charge for the consumer. If the consumer has opted for a more expensive method of delivery than the cheapest standard delivery, On Style BV does not have to reimburse the additional costs for the more expensive method.
Article 11: Complaints Procedure
The consumer is obliged to carefully inspect the products immediately after receipt. Complaints from the consumer regarding defects in the product or delivery that are visibly apparent must be communicated to On Style BV in writing by the Buyer within seven days after delivery (or within seven days after the invoice date if the products could not be delivered to the consumer).
The consumer is not entitled to return products about which no motivated complaints exist. If this occurs without valid reasons, all costs associated with returning them will be borne by the consumer. In that case, On Style BV is free to store the products at the expense and risk of the consumer with third parties and, at the consumer's request and expense, to return them to the consumer.
Article 12: Force Majeure
In the event of force majeure, On Style BV is not obliged to fulfill its obligations towards the other party. On Style BV is entitled to suspend its obligations for the duration of the force majeure.
Force majeure is understood to mean any circumstance independent of its will that wholly or partially prevents the fulfillment of its obligations towards the other party. These circumstances include strikes, fire, business interruptions, energy failures, failures in a (telecommunication) network or connection or communication systems used and/or the unavailability of the webshop at any time, non-delivery or late delivery by suppliers or other third parties engaged, and the absence of any government permit.
Article 13: Disputes
Agreements between On Style BV and the consumer to which these general terms and conditions relate are exclusively governed by Belgian law. Agreements between On Style BV and the consumer are exclusively governed and interpreted in accordance with Belgian law.
In case of any disputes concerning the validity, interpretation or execution of such agreements, the consumer must first contact On Style BV to reach an amicable settlement.
In the absence of an amicable settlement, all disputes or disagreements that may arise from the agreements concluded between On Style BV and the consumer will be submitted to the competent courts.
Article 14: Personal Data
On Style BV will process the consumer's data exclusively in accordance with its Privacy Statement. The applicable laws and regulations will be observed.
Article 15: Intellectual Property
The consumer explicitly acknowledges that all intellectual property rights of displayed information, communication, or other expressions related to the products and/or the webshop belong to On Style BV, its suppliers, or other rights holders.
Intellectual property rights include patent, copyright, trademark, design, and model rights and/or other (intellectual property) rights, including technical and/or commercial know-how, methods, and concepts, whether patentable or not.
The consumer is prohibited from using and/or making changes to the intellectual property rights as described in this article, such as copying, reproduction, redistribution, and sublicensing, without the express prior written consent of On Style BV, its suppliers, or other rights holders, unless it solely concerns private use of the product itself.
Article 16: Reviews
Parts of this website offer users the opportunity to post and exchange opinions and information in certain areas of the website. Ontuning.be does not filter, edit, publish or review comments prior to their presence on the website. Comments do not reflect the views and opinions of Ontuning.be, its agents and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable law, Ontuning.be shall not be liable for the comments or for any liability, damages or costs caused and/or suffered as a result of the use of, and/or the posting of, and/or the appearance of the comments on this website.
Ontuning.be reserves the right to monitor all comments and to remove any comments that may be considered inappropriate or offensive or that infringe these general terms and conditions.
You warrant and represent that:

The establishment and visiting address is located at 9810 Nazareth, Steenweg Deinze 150 bus 12, Warehouse M3 (New Westral Business Park). Visits are by appointment only.
On Style BV aims to respond to e-mails within 24 hours. If complaints are reported to On Style BV, the consumer will in any case be informed within 14 working days of the period within which he will receive a proposal from On Style BV to resolve the dispute.
If any provision of these General Terms and Conditions is unlawful, void or for any other reason unenforceable, then this condition shall be deemed severable from these General Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions. These General Terms and Conditions constitute the entire agreement between the consumer and On Style BV with respect to the subject matter contained herein.
In the event of nullity, invalidity or unenforceability of a provision, On Style BV and the consumer will make every effort to replace the provision with a valid and enforceable provision that most closely approximates the intentions of the parties.
These general terms and conditions cannot be tacitly deviated from. The mere toleration of consumer conduct contrary to the agreed terms does not imply a waiver by On Style BV of the content of the general terms and conditions.
